CONSIDERING
REGULATION OF THE MINISTER OF FINANCE No. 103/PMK.04/2006 ISSUE OF LICENSE TO WRITTEN GUARANTEE CENTRALLY TO PT PERTAMINA (PERSERO)

THE MINISTER OF FINANCE OF THE REPUBLIC INDONESIA,

Reading:

Law No. 22/2001 dated November 23, 2001 on Natural Oil and Gas.

Considering:

• 1. that, on outstanding import duty, penalty, interest, and taxes in the framework of import on PT PERTAMINA (PERSERO), it is necessary to issue a decree on issuance of license to use Written Guarantee as security;
• 2. that, to meet the requirements of the license to use Written Guarantee Centrally to PT PERTAMINA (PERSERO) requires time;
• 3. that, based on the considerations as mentioned above, it is deemed necessary to issue decision of the Director General of Customs and Excise on Written Guarantee on Pertamina in relation to change of form Pertamina to State Limited Liability Company.

In view of:

• 1. Law No. 10/1995 on Customs (Statute Book of 1995 No. 75, Supplement to Statute Book No. 3612) as already amended by Law No. 17/2006 (Statute Book of 2006 No. 93, Supplement to Statute Book of 2006 No. 4661);
• 2. Law No. 19/1997 on collection of Taxes by Letter of Force (Statute Book of 1997 No. 42, Supplement to Statute Book Bo. 3686);
• 3. Law No. 22/2001 dated November 23, 2001 on Natural Oil and Gas;
• 4. Decree of the Minister of Finance No. 232/KMK.05/1996 on Procedure Payment and Fulfillment of Import Duty, Excise Duty, Penalty, and Taxes in the framework of Import;
• 5. Decree of the Minister of Finance No. 234/KMK.05/1996 on Procedure of Collection of Import Duty, Excise Duty, Penalty, Interest, and Taxes Payable in the framework of Import as already amended by Decree of the Minister of Finance No. 22/KMK.01/1999;
• 6. Decree of the Minister of Finance No. 147/KMK.05/1998 on Appointment of Officers for Centre of Collection of Taxes, Procedure, and Schedule of Implementation of Collection of Taxes as already amended by Decree of the Minister of Finance No. 22/KMK.01/1999;
• 7. Decree of the Minister of Finance No. 441/KMK.05/1999 on Use of Written Guarantee to Secure Payment of Import Duty, Excise Duty, Penalty, and Taxes in the framework of Import;
• 8. Regulation of the Minister of Finance No. 25/PMK.04/2005 on Amendment to Decree of the Minister of Finance No. 441/KMK.05/1999;

HAS DECIDED:

To Stipulate:

DECREE OF THE DIRECTOR GENERAL OF CUSTOMS AND EXCISE ON ISSUANCE OF LICENSE TO USE WRITTEN GUARANTEE CENTRALLY TO PT PERTAMINA (PERSERO).

FIRST:

PT PERTAMINA (PERSERO), Located at a Jl. Medan Merdeka Timur Number 1A Jakarta 10110 is given license to use Written Guarantee to secure settlement of payment of Import Duty, Excise Duty, and Other Taxes in the framework of Import on Import by PT PERTAMINA (PERSERO), whether in Oil and Gas upstream business, oil and gas downstream business, differed payment, or temporary import.

SECOND:

The license to use written guarantee is given centrally and is valid from January 1, 2007 to March 1, 2007.

THIRD:

This Decree comes into effect as from the date it stipulated.
